Cayman has held numerous discussions and made several legislative changes to address concerns raised by the EU leaders to avoid inclusion on the tax blacklist. Cayman and British Virgin Islands were up for review after being placed on a EU ‘grey list’ in 2018. In a statement following the Financial Times report, government said it has yet to receive confirmation of the EU decision. “We believe that we have introduced the appropriate legislative changes to enhance our regulatory framework, in line with the EU’s requests,” the statement read. Government, it said, has offered to make itself “available for further dialogue or clarification with the Commission and the EU Ministers of Finance”. Saunders said Leader of the Opposition Arden McLean has reached out to Premier Alden McLaughlin to get an update on how the government will respond if the recommendation is accepted by the EU finance ministers next week. “At this point, the Opposition believes that the interests of our country are best served with everyone working together to ensure that the Cayman Islands is not blacklisted. And while it is important for us to understand what actions or inactions brought us here, this is not the time to find blame, but to work together to ensure the prosperity of our financial industry,” Saunders said. Government contended, in its statement, that over the past two years, it has adopted a number of “fundamental legislative changes to enhance tax transparency and cooperation with the EU, fully delivering on our commitment to strengthen our regulatory regime and addressing the concerns reflected in the EU Council conclusions of 12 March 2019”. It comes after the Financial Times reported Wednesday that EU27 ambassadors decided to place Cayman on a list of nine territories that do not effectively cooperate with the European bloc. The decision comes just two weeks after the UK, Cayman’s lone defence at the EU table, formally left the bloc. Cayman is the only British Overseas Territory to face blacklisting. The work included installing a new roof and insulation, removing and rerouting cables and pipes, paving, landscaping, installing windows, and adding toilets, a shower, a kitchen and offices. Tara Rivers, minister of home affairs, speaking at the grand opening ceremony, said that the shelter is now a flagship emergency relief centre for Grand Cayman. “This really is truly a community effort – the much-needed renovations, including the strengthening of the roof, installing better insulation, and a number of other improvements that were necessary to bring the building in line with our robust building code,” Rivers said. The minister added that the Red Cross continues to be a key stakeholder in the government’s national disaster plan strategy. “The Red Cross is always the first open [in emergencies], as was indeed the case in the aftermath of the 7.7 magnitude earthquake that we experienced two weeks ago, when the Red Cross activated the shelter within an hour of experiencing the earthquake,” Rivers said. Obi said having a modern facility in which Red Cross volunteers and the shelter management team can meet is vital to the organisation’s operations. “One thing that is very important for people to know is that our shelter managers ... might be at work or, if it’s a weekend, at home. Within an hour, we can mobilise them and have the shelter open. The protest, which starts at 10am, has been organised by the group People for the Protection of Smith Barcadere. Group member Michelle Lockwood told the Cayman Compass she hopes Saturday will “illustrate the power of community and what can be done when we come together. “I think the beauty of Smith Barcadere is in the community. Everyone knows and loves Smith Barcadere. Locals and tourists alike. The community never asked for an enhancement. It was perfect as it is. No cabana will provide shade any better than the trees that exist there already do,” she said. “The parking has become an issue but the police should be monitoring this more effectively. This beach is for locals and we are slowly being pushed out of other beaches. Public Beach is no longer a quiet option, Governor's Beach is overrun.” The group, in a statement to the Cayman Compass Thursday, said the purpose of the protest is to bring further awareness to the proposed redevelopment and its impact on the natural state of Smith Barcardere. “The public should be given respect and a full opportunity for written and oral consultation should be carried out prior to any commencement of clearing or building on the property, so a fully informed decision can be made,” the statement read. Government has issued a tender for phase one of redevelopment plan for the South Church Street beach. The Ministry of Commerce, Planning and Infrastructure has said it will begin enhancements to the beach next month. The ministry said work will mainly be done on the land purchased adjacent to the popular beach and there will be no interference with the existing beach. According to tender documents, phase one includes construction of a retaining wall, a carpark, and adjoining office and restroom facility. The enhancement has drawn widespread criticism from the public, including from members of the Save the Cove group. Drawings submitted with the tender had initially shown two timber cabanas, a 45-space carpark, new restroom facilities, six deck platforms, walking pathways, accessibility ramps and mat, and lighting. The ministry, in a statement on the project, said only one cabana will be added to the beach. The artist rendering submitted with the statement also showed a smaller carpark. For members of People for the Protection of Smith Barcadere, that is not good enough. “Residents prefer minimal changes, with the preference being no changes to Smith Barcadere. In addition, various architectural designs were published in December 2019 and these appear to have suddenly changed on 8 February 2020,” the group said. “There are endangered species on the property, which highlights the need for upfront involvement of other government experts, such as the Department of Environment, which as yet seem to have not been consulted,” the statement added. However, the ministry, in its statement, said there are some non-native vegetation, such as invasive ‘pop-nut’ trees that will be removed to allow for the construction of the parking lot. Additionally, it said, local vegetation, such as coco-plum and seagrape trees, will be added to improve shading and beautification at the popular site. The Smith Barcadere Committee is managing the project. It has said that covenants are in place to restrict commercial activities on the enhanced park and beach. Judiciary officials told the Cayman Compass Thursday that Owen is planning to hand down his decision at 10am via video at Grand Court. Last month, at the close of the case that was filed by Cruise Port Referendum Cayman’s Shirley Roulstone, Owen had indicated that he hoped to hand down his decision this week. The two-day judicial review wrapped up on Jan. 23. The National Trust, which has also challenged the referendum, joined Roulstone’s case as its concerns were similar. Roulstone’s case, which was filed against Cabinet and the Legislative Assembly, challenges the referendum law that was passed last year specifically to pave the way for holding a vote on government’s $200 million cruise berthing and cargo project. Her attorneys argued the legislation was “unlawful” as it failed to address critical issues that would guarantee the protection of a citizen’s right to vote. However, government’s attorneys countered that it was not within the court’s remit to quash the port referendum law. A general referendum law is being drafted by government and is expected later this year. Government had undertaken several concessions that related to the initial case submitted by Roulstone’s legal team. Those concessions include amending the referendum question, which was done in late December; declaring that it has a duty to protect the environment in its decisions; and the submission of an environmental impact assessment scoping update on the project. Roulstone has been shielded from paying government’s legal costs should her action over the vote on the port project fail in the court.
