The Ministry of Labour intends to have the main body of the Employment Law (2004) come into effect on 1 September 2004, and this is what will be recommended to the Governor in Cabinet.

This date is in keeping with the law, which states: "This law shall come into operation on such date as the Governor may by Order specify and the Governor. nor may appoint different dates for the coming into operation of different portions of this law."

However, the portion of the law regarding workers' compensation shall not come into force before 1 December 2005 or a later date. This also is in accordance with the law, which states that the sections relating to workers' compensation and other provisions dependant upon these sections “shall come into force on 1 December 2005 or such later date as the Governor Mr. Roy Bodden ernor may by Order appoint.”

The Ministry for Labour, and the Department of Employment Relations, are cognizant that employers and employees need some time to understand and respond to the requirements of this important new legislation.

Over the past few weeks the Department of Employment Relations has been preparing for the implementation of the new law. Various activities have been held, including: Employment Relations officers attended a two-day retreat, where they were briefed on implementing the new law.

The Cayman Islands Law School facilitated a comprehensive training session for the entire staff of the Department of Employment Relations.

Employment Relations has prepared a fact sheet on the new law, which will be for general circulation. Other initiatives being planned are:

A media campaign explaining the new law; Briefing for all Ministries and Heads of Department, units, and sections on the new law as requested by the Ministries;

A series of district meetings to speak to employers and employees; Meetings with individual employers.
