Contest Terms & Conditions
The Ocean Conservation Month Photography Competition (the “Competition”), is presented by the Kenneth B. Dart Foundation and the Guy Harvey Ocean Foundation and administered by Dart Enterprises Ltd. (together, the “Sponsors”). The Competition is governed by these official rules (the “Official Rules”). By entering and participating in the Competition, each party (an “Entrant”) agrees to abide by the Official Rules, including all eligibility requirements, and understands that the results of the Competition, as determined by the Sponsors and their agents, are final in all respects. The Competition is subject to all applicable laws and regulations and is void where prohibited by law.
The Competition is open to Entrants, where not prohibited by law, who are legally and ordinarily resident in the Cayman Islands. Entrants may be amateur or professional photographers. Minors may only participate in the Competition with the express authorization and approval, and under the supervision of, their parent or guardian, who shall be deemed the Entrant for and on behalf of the minor.
The Sponsors have the right to verify the eligibility of each Entrant and refuse participation at their sole discretion.
The Competition begins at 12:01am on 28 August 2017 and ends at 11:59pm on 30 September 2017. (the “Competition Period”). The Sponsors reserve the right to extend or shorten the Competition Period at their sole discretion.
HOW TO ENTER
In order to be eligible for the Prizes (as hereinafter defined), the Entrant must upload a photograph at www.caymancompass.com/contests during the Competition Period and fill out all requested fields, including Entrant name, age, telephone number and email address. Entrants may submit a maximum of one (1) photograph during the Competition Period. The photograph may be taken either above or below the ocean water line and must be landscape 6×4 orientation and under 4 GB. The photograph must:
1. be the original work of the Entrant and must not have been printed, published or exhibited elsewhere or have won any other photographic competition;
2. be taken in the Cayman Islands;
3. highlight the importance of ocean conservation;
4. include a caption which indicates the date when and specific location where the photograph was taken in the Cayman Islands; and
5. not involve the willful harassment of wildlife or damage to the environment by the Entrant or contain any material this is defamatory, obscene, indecent or otherwise inappropriate or unlawful.
An entry submitted which meets all of the requirements as outlined herein will be considered an eligible entry into the Competition (an “eligible entry”).
All eligible entries received during the Competition Period will be reviewed by a panel of judges, as appointed by the Sponsors, after the closing of the Competition Period. The panel of judges will select twelve (12) Winners (each a “Winner”). Each Winner will be contacted directly by the Sponsors shortly after the selection is conducted in October and a high resolution version of the image will be requested.
Each Winner’s photograph will be displayed at an outdoor photography exhibition located at Camana Bay from 1 November 2017 to 30 November 2017 (the “Photo Exhibition”).
Additionally, each Winner will be given the opportunity to attend a shark-tagging boat trip, to take place on a date and time to be determined by the Guy Harvey Ocean Foundation (the “Boat Trip”). A Winner who is a minor must be accompanied by a parent or guardian on the Boat Trip.
Upon the request of the Sponsors, any potential Winner may be required to execute and return an Affidavit of Eligibility, Release and Prize Acceptance Form. If a potential Winner is deemed to be ineligible, that potential Winner will be disqualified.
Additional terms and conditions may apply. Incidental expenses and all other costs and expenses which are not specifically listed as part of the Photo Exhibition and/or the Boat Trip (together, the “Prizes”) in the Official Rules and which may be associated with the award, acceptance, receipt and use of all or any portion of the Prizes are solely the responsibility of the respective Winner.
Any and all applicable taxes and/or duties associated with the receipt or use of the Prizes shall be solely the responsibility of the respective Winner.
The Prizes may not be transferred by, refunded to and/or rescheduled by the Winner. No substitution or cash equivalent of Prizes is permitted. The Sponsors and their respective parent, affiliate and subsidiary companies and their respective officers, directors, employees, representatives and agents are not responsible for any typographical or other errors in the offer or administration of the Competition, including, but not limited to, errors in any printing or posting of the Official Rules, the selection and announcement of any Winner or the execution of the Photo Exhibition. Any attempt to damage the content or operation of the Competition is unlawful and subject to possible legal action by the Sponsors. The Sponsors reserve the right to terminate, suspend or amend the Competition, without notice, and for any reason, including, without limitation, if the Sponsors determine that the Competition cannot be conducted as planned or should a virus, bug, tampering or unauthorized intervention, technical failure or other cause beyond the Sponsors’ control corrupt the administration, security, fairness, integrity or proper play of the Competition. In the event that any tampering or unauthorized intervention may have occurred, the Sponsors reserve the right at their sole discretion to void suspect entries at issue. The Sponsors and their respective parent, affiliate and subsidiary companies and their respective officers, directors, employees, representatives and agents are not responsible for incorrect and/or inaccurate transcription of entry information, or for any human error, technical malfunction, lost or delayed data transmission, omission, interruption, deletion, line failure or malfunction of any telephone network, computer equipment or software, the inability to access any website or online service or any other error, human or otherwise.
The Competition and the Official Rules shall be governed by and construed in accordance with the laws of the Cayman Islands and the courts of the Cayman Islands shall have exclusive jurisdiction over any dispute arising out of or in connection with the Competition.
INDEMNIFICATION AND LIMITATION OF LIABILITY
By participating in the Competition, each Entrant agrees to fully indemnify, release and hold harmless the Sponsors and their parent, affiliate and subsidiary companies, administrator, advertising and promotional agencies and all their respective officers, directors, employees, representatives and agents from any and all liability, claims, demands, damages, losses or injury resulting in whole or in part, directly or indirectly, from that Entrant’s participation in the Competition and the award, acceptance, receipt, use or misuse of the Prizes or any information that may be considered private. The Sponsors and their parent, affiliate and subsidiary companies do not make any warranties, express or implied, as to the condition or fitness of the Prizes. The Sponsors and their parents, subsidiaries, affiliates, advertising and promotional agencies and all their respective officers, directors, employees, representatives and agents disclaim any liability for damage to any computer system resulting from access to or the download of information or materials connected with the Competition.
Copyright in all images submitted for the Competition remains with the Entrant, however, by participating, each Entrant grants the Sponsors a non-exclusive royalty free, worldwide, irrevocable, perpetual license to feature the photograph submitted by the Entrant for promotion, marketing campaigns, advertising trade, or any other purpose through any and all medium now or hereafter known (including any newspapers, websites, Facebook, Twitter, Instagram or YouTube) as well as permission for the Sponsors to use the Entrant’s name, likeness and/or comments for publicity purposes without payment of additional consideration, except where prohibited by law.
The Entrant in submitting an entry represents that he/she has the appropriate permissions associated with the use of the entry and the entry does not infringe on the copyright of any third party or any laws. The Entrant warrants and represents that any persons appearing or who are identifiable in the entry consent to the submission and use of the entry in the Competition as set forth herein.
