Indictment records released

Over 240 cases taken to Grand Court 2008-2010

Between 2 January 2008 and 31 December 2010, over 240 cases were sent from Summary Court to Grand Court by way of indictments. Some charges, like murder, must be dealt with in Grand Court. Other charges, such as burglary, may be taken to Grand Court depending on the circumstances and the defendant’s choice. 

The department keeps the files of all its cases and in recent years the information has been stored by means of a computer programme known as the Legal Case Management System. The following information was obtained from the Legal Department through the offices of Information Manager Jenesha Bhoorasingh-Simpson and Crown Counsel Marilyn Brandt. 

Information shared includes the indictment number, the alleged offence, the plea entered, the disposal, and whether trial was by judge or jury. Some entries are incomplete. Others are missing data because the case has not yet been heard — this applies especially to indictments brought toward the end of 2010, for which trials are scheduled later this year.  

The whole list is published in order to give readers insight into the variety of alleged offences and the ways in which they may be dealt with. Especially interesting is the sentences imposed when a defendant has pleaded or been found guilty, bearing in mind that the purposes of a sentence include punishment, restitution, deterrence and rehabilitation. It would be difficult to come up with a statistical summary that gives the same picture. 

The information below has been transcribed from tables provided; any errors belong to this reporter. For some cases

One phrase — nolle prosequi — needs explanation. It refers to a document handed up to the judge stating that the Crown intends that the proceedings shall not continue. The accused person is then discharged, but the discharge does not act as a bar to any subsequent proceedings arising from the same facts. A typical example would be a wounding case in which the complainant has left the Islands.

  1. It appears in many cases of rape and indecent assault the female complainant decides not to proceed. Could she have been threatened?
    I understand that internationally most rape cases are not reported to the police.

    Sentencing appears to be light or suspended in many cases.
