Jury returns 10 guilty verdicts

The jury in the Grand Court trial of Kim Moncrieffe found her guilty on ten counts of theft from her employer and not guilty on one count.

The unanimous verdicts were returned around 12.30 pm on Friday.

Mr. Justice Alexander Henderson continued the defendant’s bail until 25 October after her attorney requested a social inquiry report before sentencing.

Moncrieffe, 42, had been charged with 15 counts of theft and one of false accounting while she was accounts clerk and then accounts manager at British Caymanian Insurance.

The judge dismissed the false accounting and four counts of theft after hearing arguments following the close of the case for the Prosecution.

The total with which she had been charged was approximately $73,000. She was found guilty in respect of just over $49,000. The offences took place between 1998 and 2002.

The case for the Prosecution, presented by Crown Counsel Gail Johnson, was that Moncrieffe had responsibility for depositing money collected from customers by the underwriters. The allegation was that she deposited the cheques, but on occasion misappropriated cash.

Moncrieffe gave evidence and denied stealing any money. She told the court that the office manager sometimes took cash from the day’s receipts in order to pay commissions to staff.

Ms Johnson called rebuttal witnesses, who said commissions were paid by cheque. If commissions were paid from the cash pan, cheques would be there to balance the amounts.

Jurors began their deliberations shortly before 12.30pm on Thursday. At minutes to 5pm, Mr. Justice Henderson sent them home for the night. He noted that it is not the practice in Cayman to sequester a jury. He warned them it was extremely important that they not talk to anyone about the case or allow anyone to approach them.

Deliberations resumed shortly after 10am on Friday.

After the verdicts, the judge thanked jurors for their service and for giving up time from their daily lives for two weeks. He excused them from further service this session.
