Three people appeared in Summary Court late last Thursday charged in connection with what was called a nasty group attack.
According to the charges and background set out by Crown Counsel Toyin Salako, the female complainant in the matter was abducted from her place of abode, forced to perform oral sex on one man and then raped by another man.
The defendants are Tashika Khouri, 18, James Martin and Alton Philips, both 22. The complainant is in the same age range.
Ms Salako said the Crown’s case was that the female defendant abducted the young lady, forcing her into a car. This defendant threatened to kill her and made other threats if the complainant did not do as she was told.
The crown’s case is that oral sex did take place, after which the complainant was driven to the home of the second man, who grabbed her and raped her. She was then able to escape and get help.
Khouri was charged with abduction, conspiracy to commit an indecent act and conspiracy to commit rape.
Martin was charged with indecent assault and conspiracy to commit rape.
Philips was charged with rape.
Defence Attorney Lloyd Samson successfully argued for bail for Martin on the basis that he was of previous good character and that the matter would be contested.
Ms Salako objected to bail on the grounds that the defendant might interfere with the witness. She said the incident was a nasty group attack by the three young defendants.
Magistrate Margaret Ramsay-Hale agreed. She refused bail for the Khouri and Philips, noting that she knew them from other court matters. She also cited the nature and seriousness of the charges and strength of the evidence.
She granted bail to Martin, who had no previous convictions, but warned that she would lock him down if he breached conditions.
Because this defendant had no job at the moment, she placed him on 24-hour curfew – commonly referred to as house arrest. If he gets employment, the magistrate said she would revisit the curfew hours. He is also not to make any contact with the complainant.
The matter was set for preliminary inquiry in late September.
