
Former Chief Justice Sir Anthony Smellie, former Financial Secretary George McCarthy and the medical director of the Health Services Authority, Delroy Jefferson, are among a number of plaintiffs who have filed a lawsuit against solar panel installation company Modern Electric Ltd.
The writs, filed last week in the Grand Court, allege that Robert Tulloch, the director and owner of Modern Electric, supplied an “inferior and cheaper” brand of solar panels than those for which plaintiffs had paid.
According to the writ filed by Smellie, the former chief justice in May this year paid Tulloch a cheque for more than $18,000 for Canadian Solar 400WMono-Crystalline solar panels and roof mounts. Instead, the writ notes, the company delivered “an inferior and cheaper brand of solar panels, namely Aptos”.
Similarly, McCarthy, in his writ, claims that he gave Tulloch a cheque for $14,303 on 17 May as a retainer for the same type of Canadian Solar panels and racking roof mount sets, but also received the Aptos panels instead.
Jefferson and two other plaintiffs – Courtney Cummings and Denise Cummings – give similar accounts, each involving payments of $18,241, in their writs.
Each of the writs accuse Tulloch and Modern Electric of being in “fundamental and repudiatory breach” of contract.
The plaintiffs are seeking the return of the money they paid, as well as interest and costs.
