Father of two on trial for child pornography

The trial of a man accused of possessing indecent images of children began in the Grand Court on Wednesday.

“This is all about Freddy Manuel Diaz having and accessing child pornography of young children, some babies,” said prosecutor Ffion Tomos, as she opened the case against Diaz on 17 Nov.

Diaz, 33, of West Bay, was arrested and charged by the RCIPS after authorities in the US alerted Cayman police that a Cayman-based IP address was used to access and download child pornography. The IP address was later connected to Diaz.

The jury heard that after officers learned the IP address was connected to Diaz, they went to his home. Armed with a search warrant, the officers seized several laptops, mobile phones and hard drives.

“On the computer, which belonged to Diaz, officers found two Category A images, and a further three Category C images on a hard drive plugged into the same computer,” said Tomos.

Category A images are pictures or videos which depict extreme nudity, exposed genitalia or sexual penetration. Category C images depict children in provocative positions with little-to-no nudity.

“One of the images depicted a child between 18 to 24 months old,” said Tomos. “Officers also searched the computer history and found that Diaz’s computer used file-sharing programmes to access child pornographic videos.”

The jury heard that one of the videos showed sexual relations between family members.

“The computer history revealed that he watched this video for 134 seconds,” said Tomos.

“This was not a one-off incident either. The history shows that Diaz’s computer was used to access these websites time, and time, and time again; each time in the late hours of 1 or 2am or early in the morning around 7am.”

Diaz denies the allegations. The trial continues Thursday.
