Defense attorney not yet able to apply for bail
Devon Elmore Scott, 38, appeared in Summary Court on Monday on charges that included aggravated burglary and wounding.
Magistrate Valdis Foldats explained to him that aggravated burglary must be dealt with in the Grand Court, so all he could do was transmit the file to the higher court.
Scott is accused of committing a burglary on Aug. 16 at a premises on Arlin Reid Drive, Cayman Brac, and having a knife with him at the time.
A related charge of wounding a female at the premises was also sent to the Grand Court.
In connection with the same incident, Scott was charged with damage to a vehicle at the premises and assault causing actual bodily harm to a male. These two charges remain in the Summary Court.
A separate incident in Bamboo Bay resulted in charges of criminal trespass and damage to property. Scott is accused of going to a private residence without permission around June 28-29 and damaging a vehicle on the premises. This file also remained in the Summary Court.
Defense attorney John Furniss said he wanted to apply for bail for Scott, who has relatives in Grand Cayman with whom he could stay. Unfortunately, he had not yet been supplied with a specific address to give to the court.
Because the law says the charge must be transmitted “forthwith,” Mr. Furniss assumed that the magistrate would not hold the matter over until the next day.
The magistrate agreed. He set the next mention date for Aug. 29 in Grand Court. However, it was pointed out that Mr. Furniss could get the matter brought forward once arrangements were made for a bail application. Scott remains in custody.
