Formal charges have been filed against the West Bay man arrested in connection with last year’s alleged homophobic attack on two men, Director of Public Prosecutions Simon Davis has confirmed.
Davis, in an emailed comment to the Cayman Compass on Thursday, said Derrick Osney Bush was formally charged with assault offences “contrary to” section 204 Penal Code and is to appear in court on 22 June.
Those charges, he said, had been filed last week.
Section 204 states that a person who unlawfully and maliciously wounds or inflicts any grievous bodily harm upon any other person, either with or without any weapon or instrument, commits an offence and is liable on conviction to imprisonment for seven years.
The announcement of the charges follows concerns over the delay in the case from local activists and an anonymous donor, who offered a $10,000 reward for information about the alleged attack.
The donor, in a statement to the Compass, said they were “thoroughly disappointed” there had been no progress in the case, in spite of video evidence.
Following the assualt on the two men 16 months ago, that left one victim with a broken nose, a local philanthropist stepped forward, offering a financial incentive for information leading to an arrest and conviction.
Police, in response to concerns raised on the 24 May episode of ‘The Resh Hour’, said that the complainants in the case were recently contacted and updated on the status of the investigation.
“The investigation into this case was completed and a case file submitted to the Office of the Director of Public Prosecutions for ruling,” the RCIPS said in a statement to the Compass.
