Bodden Town murder retrial set for January

James Javon Dixon, who pleaded not guilty to shooting dead his friend outside a Bodden Town convenience store, will face court again for a retrial on 23 Jan. 2024.

In Grand Court on Friday, 15 Sept., Judge Cheryll Richards set the date, adding that a case management hearing will take place first on 23 Nov. Dixon was remanded into custody.

The defendant is charged with murder in relation to the shooting death of 32-year-old Jovin Omar Fuentes on 1 July 2022.

In April and March this year, a six-week trial in Grand Court ended in a hung jury when, following lengthy deliberations, members could not reach a unanimous verdict.

Cayman’s Judicator Act requires that, in cases of murder, all 12 jurors must agree for there to be a guilty or not guilty verdict.

However, for the charge of manslaughter, a unanimous verdict, although preferred, is not necessary. A majority verdict of at least nine to three jurors voting either way can suffice.

A new jury will be selected for the January trial.
