A man appeared in Summary Court Monday in connection with a robbery Saturday night at Mike’s Esso on Walkers Road.
David Loriburn Cranston, 35, was charged with robbery and was granted bail.
Details of the charge are that on Sept. 13, while at Mike’s Esso on Walkers Road, Cranston stole approximately CI$853.63 and US$24 belonging to Mike’s Esso and at the time of doing so used force against a named person or sought to put that person in fear of being subjected to force.
Defense attorney Laurence Aiolfi told Magistrate Adam Roberts he agreed that robbery is a “Category A” offense and therefore must be transmitted forthwith to the Grand Court. But, he said, this was subject to sufficiency of evidence.
The magistrate checked recent amendments to the law to see if he had any discretion. Crown Counsel Neil Kumar advised that the court was not entitled to address sufficiency at this stage.
The magistrate noted that robbery is a charge for which there is not a general right to bail, but the law did not stop him from granting bail.
He transmitted the charge to the Grand Court where it will be mentioned again on Sept. 26.
The magistrate then set conditions of bail, which include wearing an electronic monitor, a condition of residence, reporting to police, and a curfew. He is also not to go within 100 yards of Mike’s Esso and not to interfere with any witnesses or employees of Mike’s Esso.
