Bail refused in bomb hoax

Delvin Olif Tibbetts, 62, was remanded in custody after appearing in Summary Court on Tuesday charged with a bomb hoax.

Magistrate Grace Donalds said bail was withheld based on the nature and seriousness of the charge and the probable sentence upon conviction.

The Penal Code provides for a fine of up to $10,000 and imprisonment up to 10 years.

The allegations against Tibbetts is that, on 20 September 2007 at 9.39am, he telephoned the 911 operator and stated that there was a bomb inside the George Town Police Station and that Cayman Airways will be next.

Defence Attorney John Furniss and Crown Counsel Jenesha Bhoorasingh agreed that the matter could be dealt with only in the Grand Court.

Mr. Furniss described the incident as stupid.

In his application for bail, Mr. Furniss said Tibbetts, a retired carpenter, has lived all his life in Cayman Brac and would not abscond. He also referred to the defendant’s age and lack of previous problems with authorities. He asked that the next mention take place in Cayman Brac.

Ms Bhoorasingh said the Crown strenuously objected to bail. She said the phone call had caused the whole police building to be vacated. The call made threats not only to the police building but also to Cayman Airways.

Under the Bail Law, she pointed out, Tibbetts was not entitled to bail. His age was not a qualification for bail.

After the magistrate ruled on bail, a preliminary inquiry was set for 9 October. Tibbetts was remanded in custody until then.
