Grand Court Justice cleared

The Cayman Islands Grand Court Justice who was arrested in September on allegations of misconduct in a public office has been exonerated.

Judge Alexander Henderson said he received a letter this evening which was signed by Attorney General Samuel Bulgin stating the investigation had been “discontinued with immediate effect and is therefore at an end.”

The letter was dated 12 November and sent to Campbell’s law firm, where Mr. Henderson’s attorney Shaun McCann works.

“We further advise and confirm that Mr. Justice Henderson is no longer the subject of the aforementioned or any investigation. The entire episode has clearly caused inconvenience and discomfort to your client, which is regretted.”

Mr. Henderson was arrested by officers with a special investigative team from the UK Metropolitan Police on 24 September in connection with an on-going misconduct and corruption probe at the Royal Cayman Islands Police Service and local judiciary.

His home and office were searched following the arrest. Investigators claimed Mr. Henderson had improperly used his influence as a member of the judiciary in seeking to determine the source of letters published in a local newspaper.

The letters were critical of the judiciary and Mr. Henderson was concerned they may have amounted to contempt of court.

Mr. Henderson was never charged with any crime. A visiting judge recently quashed warrants used by police to search the justice’s home and office after ruling those documents had been improperly and illegally obtained.

Attorneys for Mr. Henderson are also challenging his arrest, claiming it was unlawful.

“I’m relieved but not surprised,” Mr. Henderson said Thursday night. “I never did think this was a proper investigation. It’s always been an abusive and improper proceeding.”
