Magistrate refuses bail, explains right to reapply
Daniel Alex Bennett, 26, appeared in Summary Court on Friday, charged with attempted murder and a firearm offense related to the incident in which a shot was fired during Batabano festivities in downtown George Town on May 3.
Bennett is accused of possessing, with Todd Omar Bowen, a 9mm handgun except in accordance with the Firearms Law. That charge could be dealt with in either Summary Court or Grand Court, but Bennett also faces the attempted murder charge, which can be dealt with only in the higher court.
Attempted murder involves an act of such a nature as to be likely to endanger human life.
Bowen, 29, appeared in court on these charges on May 5, and they were transmitted to Grand Court, where he is to appear on May 16.
Crown Counsel Candia James asked that Bennett’s matter also be put for May 16.
Defense attorney Prathna Bodden made an application for bail on Bennett’s behalf, and Ms. James outlined the Crown’s objections. Magistrate Valdis Foldats withheld bail but told Bennett he had the right to apply again in the Grand Court.
Police records showed that Bennett, who has a Prospect address, was arrested on May 7.
The gunshot occurred around 6:50 p.m. in the vicinity of Dr. Roy’s Drive. No one was injured.
