The Court of Appeal handed down its decision on Thursday and rejected the Crown’s request for a retrial.
Welcome was suspended from duty after the incident that led to the charge. He was terminated from the police service after conviction in June 2012. He had been sentenced to six months imprisonment, but was granted bail pending appeal.
The court heard arguments last week from attorney Thomas Lowe on Welcome’s behalf. The single point had to do with the judge’s instructions to the jury about the mental element necessary in determining whether force used was reasonable or unreasonable.
