Brian Borden charged with West Bay murder

Case goes to Grand Court for mention on Friday, 24 August

Brian Emmanuel Borden, 27, appeared in Summary Court on Monday charged with the murder of Robert Macford Bush, 28, in West Bay on the night of Tuesday, 13 September, 2011. He is also accused of possessing an unlicensed firearm, a 12-gauge shotgun.

Crown Counsel Nicole Petit said the fatal shooting occurred at the intersection of Birch Tree Hill and Captains Joe and Osbert Road shortly after 11pm.

Magistrate Kirsty-Ann Gunn transmitted the matter to Grand Court in Grand Cayman because murder is a charge that can be dealt with only in the higher court. She asked for an outline of the Crown’s case against Borden. On that basis she remanded him in custody, citing the nature of the charges, the strength of the evidence and the likelihood of further offending.

Attorney John Furniss represented Borden, who was arrested on 7 August.

The defendant will appear in Grand Court on Friday, 24 August.
