Driver’s alcohol level was .173, police say
Patrick Ramond Brooks-Dixon, previously charged with causing death by dangerous driving, was back in Summary Court on Monday on a charge of driving while under the influence of alcohol and causing the death of Richard Douglas Martin.
Both charges relate to the same incident, which occurred around 12.30am on 30 November on the Esterley Tibbetts Highway in the vicinity of Lakeside Villas.
Magistrate Nova Hall committed both charges to the Grand Court, where the defendant is scheduled to appear on Friday, 20 January.
The new charge alleges Brooks-Dixon, 31, drove when he had consumed alcohol in such quantity that the level of alcohol in his blood exceeded the legal limit of .100 – it was said to be .173.
He is further charged with using a vehicle, a Chevy Trailblazer, without a certificate of road worthiness and for which the licence had expired in April.
The magistrate extended his bail under terms previously imposed. They include a surety in the sum of $10,000; curfew from 9pm to 6am; surrender of passport; and reporting to the police station. The final condition is that the defendant is not to enter a liquor-licensed premises or consume alcohol.
